PUBLIC NOTICE | Proposed Termination of CAP for USTs at Terrible Herbst #148 in Lake Havasu City
The Arizona Department of Environmental Quality (ADEQ) is providing notice in accordance with Arizona Administrative Code (A.A.C.) R18-12-264.01, that a Corrective Action Plan (CAP) dated June 6, 2014, is being considered for termination under A.A.C. R18-12-263.02(J). The CAP contained a proposal to demonstrate proposed corrective actions would be protective of public health, welfare and the environment. The CAP recommended remediation of the contamination using a dual-phase extraction (DPE) single pump remediation system. Subsequent to approval of the aforementioned CAP, Terrible Herbst, Inc. installed new wells and collected new data indicating that DPE may not be the ideal remedial method. During a facility meeting held on September 1, 2016, ADEQ agreed that Terrible Herbst, Inc. could evaluate an alternative remedial method to address the on-site contamination. Therefore, ADEQ has decided to terminate the existing CAP and request a new CAP.
