Public Notice | Call for Comments on Renewing an Air Quality General Permit and Issue Revisions for Air Quality Control Permits


Notice Read the Following: The Arizona Department of Environmental Quality (ADEQ) has reached a preliminary determination and is proposing to renew the Air Quality General Permit for Soil Vapor Extraction Units, and issue revisions of the Air Quality Control General Permits for Crushing and Screening Plants, Concrete Batch Plants, and Hot Mix Asphalt Plants. General Permits are a type of permit that applies to a class of sources; consequently, these revisions will affect multiple sources throughout the state. These permits contain requirements from the Federal Clean Air Act, Arizona Revised Statute 49-426, the Arizona Administrative Code, Title 18, Chapter 2 and applicable regulations from Maricopa, Pima, and Pinal county codes.

The Air Quality Control General Permit for Soil Vapor Extraction Units is a renewal of the current permit that will expire on June 30, 2016. The Soil Vapor Extraction Unit General Permit covers stationary facilities outside of Maricopa, Pima and Pinal counties and portable facilities statewide. Facilities permitted under the proposed Soil Vapor Evaporation Units General Permit will emit the following air contaminants: particulate matter, particulate matter less than 10 microns, particulate matter less than 2.5 microns, nitrogen oxides, carbon monoxide, and volatile organic compounds.

The Crushing and Screening Plants, Concrete Batch Plants, and Hot Mix Asphalt Plants General Permits are being revised to incorporate conditions which allow operators of facilities covered by the general permit to make move notifications and compliance certifications using ADEQ’s “myDEQ” online portal ( Currently, these submittals must be made using printed documents.

ADEQ will consider all comments received in making a final decision on the proposed permit. Everyone commenting will receive notification of the final decision. People who file comments on the permit will have the right to appeal the final decision as an appealable agency action to the Office of Administrative Hearing (OAH) pursuant to §41.1092.03, and the appeal must be filed within thirty (30) days after the issuance of the final decision. The OAH may sustain, modify, or reverse the final decision.
