[ADEQ Rulesletters] New Soil Remediation Standards Rule Training

Dear Soil Rule Stakeholders:

 

We are please to announce that the soil rule revisions passed
unanimously out of the Governor's Regulatory Review Council (GRRC) on
Tuesday, March 6. It will become effective May 5th. Thank you for your
valuable input as the rule was developed.

 

The new language updates and revises 18 A.A.C. 7, Article 2 to be
consistent with current scientific data and statute. The revisions will:
1) revise and update the predetermined Soil Remediation Levels (SRL); 2)
replace the Voluntary Environmental Mitigation Use Restriction (VEMUR)
requirement with the Declaration of Environmental Use Restriction (DEUR)
requirements; 3) expand the determination of compliance with SRLs to
include the use of soil gas analyses; 4) revise language regarding the
letter of completion to add alternative closure documents consistent
with statute; and 5) require the use of 1 x 10-6 excess lifetime cancer
risk level for remediation at sites if the current or currently intended
future use is a school or child care facility where children are
reasonably expected to be in frequent and repeated contact with the
