In 2015, legislation expanded the abilities of ADEQ’s State Lead Program to conduct three types of “noncorrective” actions. ADEQ’s State Lead Program will be responsible for hiring and overseeing qualified professionals needed to perform the actions. Noncorrective actions in the State Lead Program include:1

  • Underground Storage Tank (UST) permanent closure
  • Confirmation of suspected releases
  • Baseline assessments

Eligible applicants include UST owners, operators and property owners. An applicant may request more than one type of action for the UST facility. Participation requires the State Lead Program to have permission from the current property owner to conduct the work. The law authorizes ADEQ to prioritize applications based on site-specific criteria related to risk and the financial ability of the applicant to conduct the action with their own monies. The program is subject to the availability of monies allocated from the UST revolving fund.
