With each application submitted for approval pursuant to Arizona Revised Statutes (A.R.S.) § 49-762.03, the applicant must remit an initial fee in accordance with one of the schedules listed below. ADEQ does not review a plan until the appropriate fee is received from the applicant.

Pursuant to Laws 2008, Ch. 291, § 12, for a limited period of time, the Solid Waste Facility Plan Review Fees are increased. The increased fee and the time period during which each increased fee is effective are described below.

Billing
The hourly rate of $105.00 applies to solid waste facility plan review services rendered from Oct. 20, 2008 though June 30, 2009. This hourly billing rate applies to all direct labor hours spent working on the review of a plan. In addition, ADEQ will bill for other reasonable direct cost that are incurred but not included in the hourly billing rate, including but not limited to any laboratory analysis charges, public notice advertising, and public hearing costs.

ADEQ will issue a final itemized bill after the department issues the approval or disapproval of an application. If the cost of reviewing the plan is less than the initial fee, the difference will be returned to the applicant. If the cost exceeds the initial fee, the applicant must reimburse ADEQ for the difference, up to the maximum fee.

Review of Bill
An applicant who disagrees with the final bill received from ADEQ for plan review may make a written request to the Director for a review of the bill and may pay the bill under protest. The request for review must specify the matters in dispute and must be received by ADEQ within ten working days of the date of receipt of the final bill.

Unless ADEQ and applicant agree otherwise, the review must take place within 30 days of receipt of the request to review. Notice of the time and place of review must be mailed to the requester at least ten working days prior to the review. The director must make a final decision as to whether the time and costs billed are correct and reasonable. The final decision must be mailed to the applicant within ten working days after the date of the review and is subject to appeal pursuant to A.R.S. §§ 49-769.
