Air Quality Division: Plans: Applicable State Implementation Plan (SIP) Modernization 2010

This State Implementation Plan (SIP) submittal contains ADEQ rules that became effective 2004 - 2009 and are applicable statewide. Due to a delay in the procedure to codify the rules administered by the Arizona Secretary of State Leaving ADEQ Web site, two of the rulemakings are not yet codified. The Mineral Tailings Rule and the Repeal of Appendices 10 & 11, are being submitted in this SIP as Notices of Final Rulemakings (NFRMs). ADEQ commits to submit the codified versions as a SIP supplement as soon as practicable.

Consistent with the provisions of Arizona Revised Statutes Leaving ADEQ Web site § 49-104, 49-404, 49-406, and the Code of Federal Regulation Leaving ADEQ Web site, Title 40, § 51.102 through 51.104, and Appendix V to Title 40 CFR Part 51, revisions to Arizona's State Implementation Plan (SIP) must be submitted to the U.S. Environmental Protection Agency (EPA) Leaving ADEQ Web site by the director of the Arizona Department of Environmental Quality (ADEQ) on behalf of the Governor. Once approved by U.S. EPA as published in the Federal Register with an effective date, the provisions contained in the SIP revision become enforceable by U.S. EPA and Arizona.
