PUBLIC NOTICE | Renewal & Revision to Air Quality Control Permits issued to Energy Fuels Resources Permit #s 62877,62878 and 63895
ADEQ proposes to issue renewals of and a significant revision to Air Quality Control Permits held by Energy Fuels Resources. This facility is subject to the requirements of the Federal Clean Air Act, Code of Federal Regulations, Arizona Revised Statute 49-426 and the Arizona Administrative Code, Title 18, Chapter 2.

Energy Fuels Resources (USA) Inc. permits are for the operation of uranium mines at Canyon Mine (approximately 6 miles south of Tusayan, Coconino County), EZ Mine (approximately 37 miles south of Fredonia, Mohave County) and AZ1 Mine (approximately 35 miles south of Fredonia, Mohave County). These facilities are sources of particulate matter and products of combustion (carbon monoxide, nitrogen oxides, sulfur dioxide and volatile organic compounds).

Public Comment Period

You have an opportunity to submit written comments on the permit renewals and revision and make oral comments at the public hearing. Written comments must include the name, mailing address, signature of commenter and/or their agent or attorney and clearly state reasons why the permit should or should not be issued. Grounds for comment are limited to whether the permits meet the criteria for issuance spelled out in the state air pollution control laws or rules.

ADEQ will consider all comments received in making a final decision on the proposed permits. Everyone commenting will receive notification of the final decision. People who file comments on the permits will have the right to appeal the final decision as an appealable agency action to the Office of Administrative Hearing (OAR) pursuant to §41.1092.03, and the appeal must be filed within thirty (30) days after the issuance of the final decision. The OAR may sustain, modify, or reverse the final decision.
